Default I married foreigner (Shinto). We did social marriage in India never registered. Can i

We never registered the marriage. The ceremony was a social (Hindu) one. I am Hindu, she is Shinto (Japan). Now we want to break ties. Should i file for divorce or should request the courts to annul the marriage.

if you have NO legal records of marriage, then you don't have to worry, you are already officially as good as single, right?

The Hindu Marriage between you a Indian Hindu & she a Shinto Japanese is as of itself is in doubt as far being valid under the Hindu Marriage Act,1955.

Firstly she is not domiciled in Indian where the Hindu Marriage Act,1955 extend and applies, nor the Shinto religion included in the list of religions which can be considered part of Hindu religion such as Buddhist, Jaina or Sikh religion, and person following any of these are considered Hindu as far for the purpose of the Act. There is nothing to prove that any person following Shinto religion will be governed by the Hindu law or by any custom or usage as part of that law in respect of any of the matters dealt with herein if this Act has not been passed.

Your Hindu marriage itself is Void Ab into & if you so desire can seek decree of nullity by getting this declared as Void marriage from the Family Court of Competent Jurisdiction in India.
